TERMS AND CONDITIONS OF THE KOLOROWY WIATR ONLINE STORE

1. General Provisions

  1.  Kolorowy Wiatr online store, operating at kolorowywiatr.shop, is operated by Alicja Aksamit, with its registered address at ul. Wróblewskiego 6a, 51-627 Wrocław, Poland.

  2. The store can be contacted via email at kolorowywiatr.shop@gmail.com.

  3. These Terms and Conditions set out the rules for using the Store, placing and processing orders, making payments, delivery of Products, consumer rights, and the rules concerning complaints and returns.

  4. The Store sells handmade jewellery, in particular necklaces made using natural stones and other materials.

  5. To use the Store, you need a device with Internet access and an up-to-date web browser.

2. Products

  1. Products offered in the Store are handmade.

  2. The Store may offer:

    • unique, one-of-a-kind necklaces,

    • models available on a regular basis,

    • products made to individual order.

  3. Due to the handmade nature of the products and the use of natural stones, individual pieces may differ slightly in colour, shape, size, structure, arrangement of stones, and other visual characteristics.

  4. Natural inclusions, minor irregularities, colour variations, and differences in the colour and structure of stones are natural characteristics of minerals and do not constitute a defect in the Product.

  5. Product photographs displayed in the Store are for illustrative purposes. The actual colour of a stone may vary slightly depending on lighting, screen settings, and the individual characteristics of the particular stone.

3. Placing Orders

  1. Information about Products presented in the Store constitutes an invitation to conclude a contract.

  2. To place an order, the customer must:

    • select a Product,

    • add it to the shopping cart,

    • proceed to checkout,

    • provide the required information,

    • select a delivery and payment method,

    • accept these Terms and Conditions,

    • confirm the order and make payment if required by the selected payment method.

  3. Before placing an order, the customer has the opportunity to review and correct the information provided.

  4. After placing an order, the customer will receive an email confirming its acceptance.

  5. The sales contract is concluded when the Store confirms acceptance of the order.

4. Custom Orders

  1. Kolorowy Wiatr offers the possibility of having jewellery made to individual order.

  2. A custom order may include, in particular, the choice of stones, colour scheme, necklace length, knotting style, and other elements individually agreed with the customer.

  3. Before work on a custom order begins, the main elements of the design, its price, and the estimated completion time are agreed with the customer.

  4. Work on a custom order begins once the customer has approved the agreed design and paid the deposit in the agreed amount.

  5. Payment of the deposit confirms that the order has been accepted for processing. The remaining balance is payable in accordance with the arrangements agreed with the customer.

  6. The completion time for each custom order is agreed individually with the customer before work begins.

  7. Due to the individual nature of the Product, the right of withdrawal may not apply to a non-prefabricated Product made according to the customer's specifications or serving to satisfy the customer's individual needs, in accordance with applicable law.

  8. If a Product is made to individual order, information about this and the rules concerning the right of withdrawal will be provided to the customer before the contract is concluded.

  9. Any limitation of the right of withdrawal does not affect the customer's rights under the provisions concerning the seller's responsibility for the conformity of the Product with the contract.

5. Prices and Payments

  1. All Product prices displayed in the Store are gross prices and are stated in Polish złoty, unless another currency is indicated for a particular Product.

  2. Product prices do not include delivery costs unless otherwise stated on the Product page or during checkout.

  3. Available payment methods are displayed during the ordering process.

  4. An order is processed after payment has been received if the selected payment method requires payment in advance.

  5. In the case of international sales, prices, currency, available payment methods, and delivery costs may be displayed in the currency applicable to the relevant market.

6. Delivery

  1. Orders are shipped to the address provided by the customer during checkout or to a selected pickup point if the chosen delivery method allows this.

  2. Available delivery methods and their prices are displayed during checkout.

  3. The standard order preparation time is usually 2–3 business days, unless a different timeframe is stated for a particular Product.

  4. For custom orders, the completion time is agreed individually.

  5. Delivery time depends on the selected carrier and is not included in the order preparation time.

  6. For made-to-order Products, the customer will be informed of the estimated completion time before the contract is concluded.

7. Right of Withdrawal

  1. A consumer who has concluded a distance contract generally has the right to withdraw from the contract within 14 days without giving any reason.

  2. The 14-day period is calculated in accordance with applicable law and, in the case of a single Product, generally begins on the day the consumer receives the Product.

  3. To exercise the right of withdrawal, the customer should inform the Store of their decision before the relevant deadline by contacting kolorowywiatr.shop@gmail.com.

  4. The customer may use the statutory withdrawal form, but this is not mandatory.

  5. In the event of a valid withdrawal from the contract, the Store will refund the customer's payments in accordance with applicable law.

  6. The Store may withhold the refund until it has received the returned Product or until the customer provides proof that the Product has been sent back, whichever occurs first.

  7. The customer is responsible for the direct cost of returning the Product, unless the Store has agreed to cover it or applicable law provides otherwise.

  8. The consumer is responsible for any reduction in the value of the Product resulting from handling it beyond what is necessary to establish its nature, characteristics, and functioning.

  9. The right of withdrawal does not apply in cases specified by applicable law, in particular to Products made according to the consumer's specifications or clearly personalised to the consumer's needs, where the statutory conditions for such an exception are met.

8. Complaints and Conformity of Goods with the Contract

  1. Kolorowy Wiatr is responsible to the consumer for the conformity of the Product with the contract in accordance with applicable law.

  2. If the Product received does not conform to the contract, has a defect, or an incorrect Product was delivered, the customer may submit a complaint.

  3. Complaints may be submitted electronically to kolorowywiatr.shop@gmail.com.

  4. The complaint should include the order number, a description of the issue, and, where possible, photographs of the Product.

  5. The Store will process the complaint within the timeframe required by applicable law.

  6. If a complaint is accepted, the Store will take appropriate action in accordance with applicable law, including repair, replacement, price reduction, or withdrawal from the contract where provided for by law.

9. Jewellery Safety and Care

  1. Jewellery is handmade and requires appropriate use and storage.

  2. We recommend removing jewellery before bathing, swimming, exercising, or carrying out activities during which it may be exposed to water, perspiration, detergents, perfumes, or other chemical substances.

  3. Natural stones may be sensitive to impact, scratching, high temperatures, moisture, or chemical substances.

  4. Care requirements may vary depending on the type of stone used. If you have any questions about caring for a particular Product, you can contact the Store.

10. Customer Reviews and Materials

  1. If a customer voluntarily sends the Store a photograph of a Product, a review, or other material, the Store may ask for permission to publish it in Kolorowy Wiatr's promotional materials.

  2. Customer materials are published only with the customer's consent and on the terms agreed with the customer.

11. Personal Data

  1. Customers' personal data is processed in accordance with applicable law and the Store's Privacy Policy.

  2. Detailed information about the processing of personal data can be found in the Privacy Policy available in the Store.

12. Out-of-Court Dispute Resolution

  1. Consumers may use out-of-court methods for handling complaints and pursuing claims where provided for by applicable law.

  2. Consumers may also seek assistance from a municipal or district consumer ombudsman or other relevant consumer protection institutions.

13. Final Provisions

  1. Matters not covered by these Terms and Conditions are governed by the laws applicable in Poland and by applicable European Union law.

  2. These Terms and Conditions are available free of charge on the Store's website in a form that allows them to be saved and reproduced.

  3. Kolorowy Wiatr reserves the right to update these Terms and Conditions in the event of changes in applicable law, the operation of the Store, or the range of Products and services offered.

  4. Changes to these Terms and Conditions do not affect rights acquired by customers before the changes take effect.
